Terms of service
By accessing or using the website, services, or consulting offerings of Bloom Intuitive Technology Solutions (“Bloom,” “we,” “us,” or “our”), including our hospitality point-of-sale (POS) consulting, implementation, training, and support services, you (“Client” or “you”) agree to be bound by these Terms of Service (“Terms”). Specific services may also be subject to separate quotes, proposals, or service agreements. If there is a conflict between these Terms and a separate written agreement, the written agreement will govern. If you do not agree, please do not use our services.
Bloom provides hospitality technology consulting services, including but not limited to point-of-sale system consultation and implementation (including Oracle-based cloud POS platforms), staff training, ongoing customer care and technical support, and operational efficiency consulting for restaurants, hotels, and other hospitality establishments in Canada and other markets where Bloom provides services.
Our services involve and integrate with third-party software platforms, hardware, payment providers, and other technology solutions, including Oracle products. Your use of such third-party platforms may be subject to separate license agreements and terms of service provided by those third parties. Bloom is not responsible for the acts, omissions, availability, or performance of third-party platform providers.
You agree to provide accurate business information necessary for us to deliver services, maintain the security of any credentials or systems provided to you, use our services in compliance with applicable laws, and pay all fees in accordance with your service agreement or quote.
Fees for services are set out in individual quotes, proposals, or service agreements. Payment terms, invoicing schedules, and late payment consequences will be specified in your applicable agreement.
Bloom aims to provide customer care support as described in our Customer Care Guarantee. While we strive for high availability, we do not guarantee uninterrupted or error-free service, particularly with respect to third-party POS platforms outside our control.
All content on the Bloom website and proprietary training or consulting materials remain the property of Bloom or its licensors. Nothing in these Terms grants you rights to Oracle or other third-party intellectual property beyond what is granted under separate licensing agreements.
Each party agrees to protect confidential business information shared during the course of the engagement and not disclose it to third parties except as required by law or agreed in writing.
To the maximum extent permitted by law, Bloom shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services, including business interruption, loss of profits, or data loss, except as caused by Bloom’s gross negligence or willful misconduct.
Either party may terminate a service agreement in accordance with the notice provisions set out in the applicable service agreement or quote.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the revised Terms.
